NY Gov. Wants Extend Gun Background Checks to 10 Days


New York Gov. Cuomo wants to increase the Background Check Waiting Period for the Purchase of Firearms in New York to a Maximum 10 Days. “We need to do everything in our power to keep guns out of the hands of people too dangerous to have them,” a Cuomo Administration Official said Saturday.

Cuomo intends to make the Issue a Priority in the Final Weeks of the State Budget talks with the Legislature, which are set to conclude by April 1st. “In light of the school shooting tragedy in Florida, the governor is seeking to make the SAFE Act, which is already the strongest gun safety law in the country, even stronger,” the Cuomo Source said. “This is about the safety of New Yorkers and the safety of our children.”

Under Current Law, anyone seeking to Purchase a Pistol, Shotgun or Rifle in New York must undergo a Background Check. That Check has Three possible outcomes:

- The First allows the Purchase to proceed Immediately.

- The Second is a Denial of the Sale.

- The third is a Call for a Delay in the Delivery of the Gun. That Delay, under Current Law, can last only up to Three Days and then the Gun can be Delivered to the Buyer.

Cuomo will seek to push that Maximum Delay to 10 days. Doing so would give the FBI more opportunity to let the Dealer know if they found something in the Database that should stop the Sale.

“This proposal is yet another critical measure that will strengthen New York’s background check system and prevent guns from getting into the wrong hands,” said Rebecca Fischer, Executive Director of New Yorkers Against Gun Violence.

The main Problem with Three days is the Weekend. A Buyer comes in late Thursday. By Monday the Wait Period has ended, and the Gun is sold. The biggest change, no matter how many days, make them Business Days.

The Democrat-controlled Assembly has already pushed a Gun Control Package that includes the 10-day Waiting Period.

The potential Roadblock rests with the GOP-controlled Senate. The Senate Republicans haven’t passed a Single Piece of Gun Control Legislation after being heavily attacked by their Base for allowing the Passage of the SAFE Act in 2013 weeks after the Sandy Hook Elementary School Mass Shooting in Newtown, Connecticut.

The Senate Republicans in a Budget Resolution they put forward this past week sought to Remove the Policy Proposals that Cuomo had already included in his State Spending Plan. They have argued the Budget should be about Funding, not Policy matters which can be dealt with separately.

The Senate recently Passed a Package of Bills designed to Strengthen School Safety, including having Armed Security at each School. But None of the Bills dealt directly with Gun Control Matters.

The Proposed Extension of the Background Check Waiting Period is the Second Gun Control Initiative Cuomo wants as part of the Budget talks. He already had Proposed a Law that would take Guns Away from All Convicted Domestic Abusers instead of just those Convicted of Felonies.

The Cuomo-controlled State Democratic Party also recently began a Six-figure Television, Newsprint, and Social Media Campaign that Highlights the Governor’s successful Push of the SAFE Act and also Targets Seven New York Congressional Republicans for their Ties to the National Rifle Association (NRA).

Tom King, an NRA Board Member from New York and President of the State Rifle & Pistol Association, is Opposed to the 10-Day Waiting Period and said Cuomo shouldn't be attaching the Issue to the Budget. “If the state and everyone else is doing their jobs, there wouldn't even be a need for a waiting period,” King said.
