Groups ask court to block WOTUS

The American Farm Bureau Federation (AFBF) and a coalition of other farm groups have asked a federal district court in Texas to block the Waters of the U.S. (WOTUS) rule.

“What we’re trying to do is ensure that the 2015 rule does not go into effect while all of the regulatory prospects are so uncertain,” said Danielle Quist, senior counsel for public policy at the AFBF.  “They can keep going on for several years.”

The filing follows publication of a rule delaying WOTUS for two years while the EPA and U.S. Army Corps of Engineers consider possible repeal or revision, according to Quist.

“We just need to have a continuity so that everybody knows what the WOTUS rule means, where they are until such time as we have final resolution on the regulations,” said Quist.

Some states and environmental groups have challenged the delay and have said they’ll seek court orders allowing WOTUS to go into effect.
