NY Senate GOP Must Comply with BOE Subpoenas


A New York State Supreme Court Justice, Roger D. McDonough, in Albany has Ruled that New York Senate Republicans must Comply with Subpoenas issued by the State Board of Elections Chief Enforcement Counsel looking deeply into potential Violations of State Election Law.

The Subpoenas, issued in March by the Office of State Board of Elections (BOE) Chief Enforcement Counsel, Risa Sugarman, seeking Information about Spending from the State Senate GOP’s Campaign Committee and Housekeeping Accounts, and their Relationships with a number of Campaign Vendors.

The Housekeeping Account under Law is supposed to be used only for Party Building purposes and not to Help Individual Senate GOP Candidates.

In a prior Filing, Sugarman’s Unit argued that the Senate GOP’s Housekeeping Account appeared to be used during the 2016 Elections to help Individual Candidates. The Senate GOP narrowly maintained a Majority after Winning several Swing Districts where Candidates may have gotten help from the Housekeeping Account, which can take Uncapped Donations.

The Senate GOP’s Attorneys have argued that the Subpoenas were overly Broad, abridged Free speech Rights, and did not have a Factual Basis, in seeking to Quash them. Judge McDonough Ruled earlier this Month that those Arguments lacked Merit.

The Senate GOP has been Ordered to Comply with the Subpoenas within 45 Days of the Decision.

“We are reviewing the decision and will explore all of our options,” said Senate Republican Spokesman Scott Reif.
