A 49-year-old Milwaukee man accused of killing the mother of his child was charged Sunday with homicide and felony child abuse.

James Hutchins was arrested last week in connection with the death of 26-year-old Tyvitta G. Dischler. Investigators have said they believe the case to be a domestic-violence homicide.

Dischler had previously sought a restraining order against Hutchins, but a court commissioner denied an injunction after a hearing May 10, according to court records.

A new hearing had been rescheduled for June 22 after Dischler asked a circuit judge to rehear the petition last Monday.

Police discovered the Dischler's body Wednesday afternoon inside a home in the 4700 block of W. Brentwood Ave.

Authorities had gone to the home to search for Hutchins, who had been accused of previously striking their 5-year-old son and was wanted in a child abuse case, police said.

The manner in which Dischler was killed has not been disclosed publicly. The criminal complaint, a court document which outlines the allegations against Hutchins, was not immediately available Sunday.

Hutchins was believed to be armed with a gun when officers went to the house on Milwaukee's northwest side. He was arrested later in Racine County.

Hutchins remained in Milwaukee County Jail on Sunday on $250,000 bail and is expected back in court June 6 for a preliminary hearing.
