MO A-G files merit brief with Supreme Court

The Missouri Attorney General has filed a merits brief with the U.S. Supreme Court, supporting the case made by the National Association of Manufacturers to keep the fight against the Waters of the U.S. (WOTUS) rule in district courts.

Attorney General Josh Hawley’s office has joined a coalition of 29 states as respondents to that case. They want the Supreme Court to overturn the 6th Circuit Court of Appeals’ opinion that IT has primary jurisdiction to hear consolidated cases against the rule.

Hawley says the WOTUS rule is “unauthorized, unconstitutional and unbelievably damaging for Missouri farmers.”

President Trump issued an executive order directing the EPA and Army Corps of Engineers to reconsider the rule. That process is underway.
