<p><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.law360.com/classaction/articles/2465133?nl_pk=849d529b-1524-4716-9226-566baf6686d3&amp;utm_source=newsletter&amp;utm_medium=email&amp;utm_campaign=classaction&amp;utm_content=2026-04-15&amp;read_more=1&amp;nlsidx=1&amp;nlaidx=2">Law360 reports</a> that the Fourth Circuit has affirmed the conviction of a man who illegally accessed and leaked the private health information of former Justice Ruth Bader Ginsburg. In <em><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://law.justia.com/cases/federal/appellate-courts/ca4/24-4620/24-4620-2026-04-14.html">United States v. Russell</a></em>, the court held it was not an abuse of discretion to deny Russell&#8217;s motion to exclude statements he made to federal agents during an interview.</p>
<p>Those statements included Russell&#8217;s attempt to blame his cat for the incriminating search term, &#8220;gins,&#8221; which Russell suggested his cat had typed by running across his keyboard.</p>
<p>Before her death in 2020, Justice Ginsburg was being treated at George Washington University Hospital. In January 2019, someone posted information about her treatment on 4Chan, where, the opinion says, users were &#8220;promot[ing] a conspiracy theory that Justice Ginsburg had [already] died and prominent Democrats were covering up her death.&#8221; (Presumably the motive would have been to prevent then-President Bozo Waffles from replacing Ginsburg. I would have supported that, but the idea that &#8220;prominent Democrats&#8221; would have been competent enough to pull it off is almost as comical as the cat-blaming.) The information then spread to Twitter.</p>
<p>Wrongfully obtaining and disclosing such information is a federal crime (well, two crimes), and an investigation followed. Not surprisingly, this focused on hospital employees and contractors who had access to the hospital&#8217;s computer system. Should a hospital employee or contractor with access to the system have foreseen this? Probably. But at least two did not.</p>
<p>Hospital officials looked at the search logs to see if anyone not involved with Ginsburg&#8217;s treatment had searched for a name starting with &#8220;ginsb&#8221; during the relevant period. They found that an ER employee had searched for &#8220;ginsbur,&#8221; but decided it was unlikely he had been the leaker (he was fired, but not prosecuted). So they kept looking.</p>
<p>This led them to Russell, a contractor working as a transplant coordinator. On January 7, 2019, three searches were run using Russell&#8217;s credentials: &#8220;gins,&#8221; &#8220;barker,&#8221; and &#8220;ginston.&#8221; There was a patient named &#8220;Barker,&#8221; but no &#8220;Gins&#8221; or &#8220;Ginston.&#8221; But there was, of course, a patient named &#8220;Gins<em>burg</em>.&#8221; This was enough for a visit from federal agents. Also a visit from Russell&#8217;s boss, who decided she wanted to sit in on the interview. So she was present for the lies Russell was about to tell. </p>
<p>Russell admitted that <em>whoever</em> ran the searches had been logged in as him. He also admitted he had searched for &#8220;barker,&#8221; which he might have had a legitimate reason to do. But he denied searching for &#8220;gins&#8221; or &#8220;ginston.&#8221; Hm. So who might have run those searches while logged in as him, immediately before and after a search he admitted he <em>did </em>run?</p>
<p>He didn&#8217;t know, he told the agents, but he had a couple of theories.</p>
<p>The first was that &#8220;a coworker may have used his login information&#8221; to run the other two searches. He was being framed! Probably not, though, because the agents knew the three searches had been run within a matter of seconds. (Prosecutors argued Russell realized, correctly but too late, that &#8220;gins&#8221; might look suspicious, so he followed that with a fake but plausible search and then a search for a made-up name also starting with &#8220;gins,&#8221; hoping to cover his tracks.)</p>
<p>But the second theory is why we&#8217;re here: Russell suggested that &#8220;potentially his cat had run across the keyboard and typed in those letters.&#8221;</p>
<p>It is, of course, statistically true that if an infinite number of cats ran across an infinite number of keyboards, sooner or later one of them would type the name of a U.S. Supreme Court justice. And—to my surprise—it is possible that even a <em>finite</em> number of cats and keyboards might accomplish this during the estimated lifespan of the universe. <em>See </em>Stephen Woodcock and Jay Falletta, &#8220;A numerical evaluation of the Finite Monkeys Theorem,&#8221; 9 Franklin Open Journal (Oct. 30, 2024).</p>
<p>Woodstock and Falletta found that, even if 200,000 monkeys had 200,000 keyboards, it would be effectively impossible for them to produce the complete works of Shakespeare (the usual goal in this thought experiment) before the universe comes to an end. <em>Id</em>.; <em>see also</em> &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~It is, of course, statistically true that given enough time and access to a keyboard, a cat will eventually type out the name of a U.S. Supreme Court justice. And let's assume the amount of time required is less than the estimated lifespan of the universe. But towards the other end of the scale, there was a non-zero chance—about 5%, in fact—that just <em>one</em> monkey would produce one particular word (&#8220;bananas&#8221;) during <em>its </em>estimated lifespan. (I know—for some reason they start talking about chimps, which aren&#8217;t monkeys. Email them, not me. We&#8217;ve been over that. <em>See </em>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2008/10/clarification-m.html">Clarification: Monkey v. Ape</a>,&#8221; Lowering the Bar (Oct. 20, 2008)).</p>
<p>So I conclude it wasn&#8217;t impossible that during <em>its</em> lifetime, Russell&#8217;s cat could<em> </em>have randomly typed the name of a U.S. Supreme Court justice, even Justice Ginsburg in particular. <em>A fortiori</em>, it could have typed the shorter terms &#8220;gins&#8221; or &#8220;Ginston&#8221; during that time. Sadly, Russell didn&#8217;t have the benefit of this research in 2019. But it wouldn&#8217;t have helped anyway. Even accepting the above, the probability the cat would have typed <em>both</em> terms within a mere matter of seconds (pausing to let Russell search for &#8220;Barker&#8221;) would surely be effectively zero.</p>
<p>As you&#8217;ve probably guessed, this wasn&#8217;t the only problem with Russell&#8217;s story. When agents asked to see his work computer, he said it had been stolen. (Also not impossible!) But he did turned over a hard drive from his home computer, and even though he had tried to wipe it, the government recovered enough information to indict him. (Destroying evidence became his third charge.)</p>
<p>What, you want (another) legal issue? Fine. The main issue on appeal was whether the district court should have excluded what Russell said during the interview and thus also the hard drive. Russell argued the statements were &#8220;involuntary,&#8221; not because he was beaten or anything but because his company&#8217;s CEO was there. But the agents didn&#8217;t invite her—she just decided to sit in—and the court held the circumstances didn&#8217;t establish coercion. Russell volunteered his very unlikely story.</p>
<p>Of course, given enough judges and enough opportunities, it&#8217;s not impossible Russell might convince one with arguments like these. It&#8217;s just not likely to happen during the estimated lifespan of the universe.</p>

<p>Those of you who have been following this critically important topic since at least 2012 already know this, but maybe it&#8217;s time for a reminder. At least one every 14 years, that&#8217;s my rule. </p>
<p><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://thesmokinggun.com/buster/dui/gui-arrest-021743"><em>The Smoking Gun</em> reports</a> that a 48-year-old Kentucky man was arrested on March 26 and charged with violating that state&#8217;s law against operating &#8220;a vehicle that is not a motor vehicle anywhere in this state&#8221; while under the influence of intoxicating beverages. <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6409">Ky. Rev. Stat. § 189.520</a>. The allegations in the arrest report make out a pretty solid prima facie case:</p>
<ul class="wp-block-list">
<li>The arrest was in Bowling Green, which is indeed in that state.</li>
</ul>
<ul class="wp-block-list">
<li>While traveling along Glen Lily Road towards Stubbins Street, the officer &#8220;observed a male partially slumped over on a horse&#8221; traveling in the opposite direction on that road.</li>
</ul>
<ul class="wp-block-list">
<li>He &#8220;then observed the male begin to travel on the sidewalk still on the horse,&#8221; though the pair then returned to the roadway.</li>
</ul>
<ul class="wp-block-list">
<li>When the officer turned around and stopped them, he talked with the male and &#8220;detected the strong odor of alcoholic beverage coming from his person,&#8221; noting that he also had bloodshot eyes and slurred speech (the latter is how we know this refers to the rider and not the horse).</li>
</ul>
<ul class="wp-block-list">
<li>He &#8220;asked the male if he was OK, to which he responded yes and that he just left the liquor store and was going home.&#8221; Volunteering this information would be an example of why you shouldn&#8217;t talk to police, but it wouldn&#8217;t have mattered here because the officer &#8220;then observed a liquor store bag tied to the saddle of the horse.&#8221;</li>
</ul>

<p>The city&#8217;s arrest-report form isn&#8217;t very well designed for this situation, frankly, but the officer made it work, though without being especially creative. He noted that the vehicle&#8217;s color was &#8220;bro[wn],&#8221; but for vehicle make and model, he just wrote &#8220;other.&#8221; He does seem to have asked or maybe estimated how old the horse was, because the form gives &#8220;vehicle year&#8221; as &#8220;2024.&#8221; Would it have been so hard to check on the model, too? Is that too much to ask?</p>
<p>Anyway, as noted Kentucky is one of the relatively few states where it is pretty clear that riding a horse while under the influence (the rider, I mean, not the horse) is against the law. <em>See </em>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2012/09/man-on-horse-arrested-for-dui.html">Don&#8217;t Ride Drunk in Kentucky</a>&#8221; (Sept. 19, 2012). In many states, the DUI laws apply to &#8220;motor vehicles,&#8221; which horses are not. Sometimes they apply to &#8220;vehicles,&#8221; which I would argue (and have argued) horses also are not. But unfortunately for the suspect in this case, another Kentucky statute still defines &#8220;vehicle&#8221; as any &#8220;agency for the transportation of persons or property over or upon the public highways of the Commonwealth&#8230;.&#8221; <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55556">Ky. Rev. Stat. § 189.010(19)(a).</a> Glen Lily Road itself is a state highway, at least according to Google Maps, so that argument&#8217;s out too, even if my speculative route above is wrong in other ways.</p>

<p>Kansas! The 16th state alphabetically, 34th chronologically (admitted Jan. 29, 1861), 36th by population (about three million), second in terms of how long I lived there, and—though this is controversial—<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.disruptivegeo.com/blog/wp-content/uploads/2014/08/FlatMap_GeographicalReview_DobsonCampbell_2013Nov.pdf">seventh in flatness</a>.</p>
<p>Does it have official state crap? <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/">Yes</a>, <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/kansas-state-symbols/20531">lots</a>.</p>
<p><strong>Official state seal:</strong> the circular thing in the middle of the flag, which includes such historically accurate details as Native Americans hunting buffalo as white settlers occupy their land with no sign of discord or strife between the two groups. There is also a wagon train, meant to symbolize that, as is still true today, most travelers seen there are trying to get somewhere else. <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://kslegislature.gov/li/b2025_26/statute/075_000_0000_chapter/075_002_0000_article/075_002_0001_section/075_002_0001_k/">Kan. Stat. § 75-201</a>.</p>
<p><strong>Official state flower</strong>: the sunflower, which, <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/sunflower/16899">according to the Kansas Historical Society</a>, an 1895 state law classified as a &#8220;noxious weed.&#8221; By 1903, though, the state had <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_018_0000_article/073_018_0001_section/073_018_0001_k/">officially changed its mind</a>.</p>
<p><strong>Official state march:</strong> Like another state that I can&#8217;t remember now, but trust me, Kansas has not one but <em>two </em>official state marches: &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/kansas-march/19109">The Kansas March</a>,&#8221; by Duff E. Middleton, which dates to 1935; and &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/here-s-kansas/19110">Here&#8217;s Kansas</a>,&#8221; by Bill Post, added in 1992. I have been unable to determine in what way the original march was deficient.</p>
<p><strong>Official state bird:</strong> the Western Meadowlark. The 1937 Legislature was, however, careful to note that this was the bird &#8220;preferred by a vote of Kansas school children,&#8221; so I assume a majority of legislators hated it.</p>
<p><strong>Official state tree: </strong>the cottonwood (<em>Populus deltoides</em>). Yes, Kansas has some trees. The name &#8220;cottonwood&#8221; derives from the seeds&#8217; cotton-like attachments, which act like tiny sails in the strong prairie wind, thus helping the tree achieve its goal of getting this stuff all over your windshield.</p>
<p><strong>Official state song:</strong> &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_013_0000_article/073_013_0001_section/073_013_0001_k/">Home on the Range</a>,&#8221; of course. With music by Dan Kelley and words by the impressively named Dr. Brewster M. Higley VI, this song evidently has six verses, not just the one you probably know. (Because one of the others includes the lines, &#8220;On the banks of the Beaver, where seldom if ever / Any poisonous herbage doth grow,&#8221; it may not be surprising they aren&#8217;t more popular.) Bonus points: in 1934 <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/home-on-the-range/17165">the song was the subject of an unsuccessful copyright lawsuit</a>.</p>
<p><strong>Official state animal:</strong> &#8220;the American buffalo (<em>Bos </em>or <em>Bison americanus</em>),&#8221; designated as such in 1955. This one is interesting for two reasons. First, like <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2013/05/official-state-crap-california.html">California</a>, Kansas chose a state animal that <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://allaboutbison.com/buffalo-tracks/last-of-the-bison-by-state/">had been hunted to extinction</a> in that state, which seems rude. Second, although the bison is back now, Kansas may not be using the right Latin name. Most sources seem to use <em>Bison bison bison</em>, which obviously is much better anyway. (To be fair, the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://nationalzoo.si.edu/animals/american-bison">National Zoo</a> says &#8220;the taxonomy of bison has been under debate,&#8221; but what does it know about animals?)</p>
<p><strong>Official state insect:</strong> the honeybee.</p>
<p><strong>Official state reptile:</strong> the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://en.wikipedia.org/wiki/Ornate_box_turtle">ornate box turtle</a> (<em>Terrapene ornata ornata</em>). This turtle right here is goddamn awesome and it&#8217;s frankly embarrassing that it took until 1986 for the Legislature to make it official. Well done, sixth graders of Caldwell, Kansas. </p>
<p><strong>Official state soil:</strong> Harney silt loam. Yes! Another great choice. If there&#8217;s anything great about Kansas, it&#8217;s the dirt. There is nothing you can&#8217;t grow in Kansas except maybe a <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.ncaa.com/news/football/article/college-football-national-championship-history">college football championship</a>. What&#8217;s so great about Harney silt loam? Well, for one thing, its mollic epipedon is 10 to 20 inches thick, if you can believe that, and it includes the upper part of the argillic horizon in some pedons. That&#8217;s <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://soilseries.sc.egov.usda.gov/OSD_Docs/H/HARNEY.html">what the USDA says</a>, at least, and it may be using completely made-up words but what it means is &#8220;awesome.&#8221; Right, Kansas Historical Society? &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kansashistory.gov/kansapedia/harney-silt-loam/17238">It serves as a standard against which other soils can be compared</a>[, such as the far inferior soils of states like Nebraska, which are an embarrassment by comparison].&#8221; Right.</p>
<p><strong>Official state amphibian:</strong> the barred tiger salamander. It&#8217;s fine.</p>
<p><strong>Official state language:</strong> Spanish. Just kidding, it&#8217;s <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_028_0000_article/073_028_0001_section/073_028_0001_k/">English</a>, which must be used in any official public document or meeting. And there shall be no exceptions whatsoever, except for the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_028_0000_article/073_028_0002_section/073_028_0002_k/">many enormously broad exceptions</a> provided in the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_028_0000_article/073_028_0003_section/073_028_0003_k/">sections</a> that <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_028_0000_article/073_028_0004_section/073_028_0004_k/">follow</a>. It&#8217;s almost like the English-only rule itself was passed just to make a point, but I didn&#8217;t look at the legislative history.</p>
<p><strong>Official state theatre festival: </strong><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_029_0000_article/073_029_0001_section/073_029_0001_k/">the William Inge Theatre Festival</a> held in Inge&#8217;s hometown of Independence, Kansas.<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://ingecenter.org/about/about-william-inge/"> Inge</a> won the 1953 Pulitzer Prize for his play <em>Picnic</em> and the 1961 Oscar for Best Original Screenplay for <em>Splendor in the Grass</em>. He&#8217;s no ornate box turtle, but that&#8217;s still pretty cool. </p>
<p><strong>Official state grass:</strong> little bluestem (<em>schizachyrium scoparium</em>). Sure, but what grass couldn&#8217;t grow in Harney silt loam? </p>
<p><strong>Official state fossils:</strong> Tylosaurus, Pteranodon, and—arguably—the woodland lizard (<em>Silvisaurus condrayi</em>). Unlike any other state (in the first 16, anyway), Kansas has insisted on adopting three state fossils, one marine, one airborne, and one land dweller. At least, the Kansas Historical Society claims that the last one was adopted in 2023, but if so, it wasn&#8217;t by statute. Sometimes legislatures do this by resolution, so I&#8217;m guessing that&#8217;s what happened here. Besides, Kansas <em>has </em>an official state reptile, which is the Ornate Box Turtle, so get out of here with your &#8220;woodland lizard&#8221; or whatever.</p>
<p><strong>Official cage elevator:</strong> the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_035_0000_article/073_035_0001_section/073_035_0001_k/">cage elevator in the Kansas state capitol building</a>. To the best of my knowledge, Kansas is also the only state with an official cage elevator. According to the KHS, this cage elevator, installed in 1923, is hand-operated. I&#8217;m sure it&#8217;s safe, but if not, at least you&#8217;ll be plunging onto the <strong>official state rock</strong>, <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.kslegislature.gov/li_2020/b2019_20/statute/073_000_0000_chapter/073_037_0000_article/073_037_0001_section/073_037_0001_k/">Greenhorn limestone</a>, which sits atop some pretty awesome official state soil. So you&#8217;ll have that going for you.</p>

<p>As you know, the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.fema.gov/">Federal Emergency Management Administration</a> has the mission of providing help to those affected by natural disasters and other emergencies. One of FEMA&#8217;s major divisions is its <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.fema.gov/about/offices/response-recovery">Office of Response and Recovery</a>, which provides &#8220;guidance leadership and oversight to build, sustain and improve the coordination and delivery of support&#8221; to citizens and government units that need it. Based on that statement, the office seems to have donated many of its own commas to those in need, and that is a noble sacrifice indeed. But it does much more than that.</p>
<p>So who leads this important office within this critical government agency? <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.fema.gov/about/organization/gregg-phillips">Gregg Phillips,</a> that&#8217;s who. And what do we know about him? This:</p>

<p>Mr. Phillips brings experience in emergency and humanitarian response, state government operations and large-scale program reform. He has led organizational, process and technology redesign efforts, working closely with state, local, private, and faith-based partners. His disaster work includes implementing technology to rapidly onboard survivors and leveraging algorithms for real-time deployment decisions that supported restoration of communications and the delivery of critical medical capabilities. Mr. Phillips believes in disciplined execution and restoring public trust through measurable performance. He also once teleported to a Waffle House 50 miles away.</p>

<p>Well, I added that last sentence, but I assume FEMA is about to update its site to reflect this new information, which was <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://edition.cnn.com/2026/03/20/politics/fema-official-gregg-phillips-violent-rhetoric-teleported-kfile">publicized earlier today by CNN</a>. (Still not subscribing, CNN, but <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.thedailybeast.com/trumps-disaster-response-chief-believes-he-was-teleported-to-a-waffle-house/">others have already re-reported</a> the important details.) Philips reportedly made this rather startling claim more than a year ago, on the podcast <em>Onward</em>. That podcast discusses &#8220;alternative asset investment&#8221; opportunities, so it&#8217;s not surprising this didn&#8217;t get more attention. I&#8217;m guessing it didn&#8217;t come up in his confirmation hearing, if he was subjected to one, although what people say in those hearings doesn&#8217;t seem to matter much anymore.</p>
<p>Before joining FEMA, Phillips was best known for spewing violent rhetoric and promoting bogus election-fraud claims and other conspiracy theories on social media, as well as <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.mediaite.com/media/news/trump-fema-official-has-history-of-violent-rhetoric-and-claimed-he-teleported-to-a-waffle-house/">his insistence</a> that China was smuggling soldiers into the country to assemble a secret army here. He was not at all known for his expertise in emergency management operations, because he had none, <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.washingtonpost.com/climate-environment/2025/12/09/gregg-phillips-fema-election-fraud/">according to the Washington Post</a>. But because nobody listens to <em>Onward</em>, he was also not known for his ability to teleport. Or maybe I should say &#8220;having been teleported,&#8221; because Phillips seemed to be saying he had no direct control over the process. But he <em>was</em> thinking about Waffle House at the time he was teleported there, he said:</p>

<p>I was with my boys one time [Phillips told <em>Onward</em>], and I was telling them I was gonna go to Waffle House and get Waffle House. And I ended up at a Waffle House—this was in Georgia, and I end up at a Waffle House like 50 miles away from where I was.</p>

<p>Phillips then called the boys to give them an update:</p>
<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow">
<p>And they said, ‘where are you?’ and I said, ‘A Waffle House.’ And ‘a Waffle House where?’ And I said, ‘Waffle House in Rome, Georgia.’ And they said, ‘That’s not possible, you just left here a moment ago.’ But it was possible. It was real.</p>

<p>Unfortunately, Waffle House is not the only place Phillips has been teleported, he said, describing another incident in which he suddenly found himself in a ditch near a church 40 miles away. The report doesn&#8217;t say whether he was thinking about a ditch, let alone that specific ditch, at the time. Given the uncertainty about where he will end up and whether it will be a Waffle House, it isn&#8217;t surprising that Phillips seemed to have mixed feelings about this power. &#8220;Teleporting is no fun,&#8221; he said:</p>

<p>It’s no fun because you don’t really know what you’re doing [he said on the podcast.] You don’t really understand it, it’s scary, but yet um—but so real. And you know it’s happening but you can’t do anything about it, and so you just go, you just go with the ride. And wow, what just an incredible adventure it all was.</p>
</blockquote>
<p>It strikes me that he will probably say almost exactly that after the first major national disaster the office responds to while he&#8217;s in charge.</p>
<p>That assumes he still has the job after this week, which seems questionable partly because he&#8217;s scheduled to testify <em>next </em>week before the House Homeland Security Committee about the risks of the current shutdown. &#8220;Lawmakers may also end up asking Phillips about some of his wilder and more extreme comments when that time comes,&#8221; <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.mediaite.com/media/news/trump-fema-official-has-history-of-violent-rhetoric-and-claimed-he-teleported-to-a-waffle-house/">one report</a> speculated, and that seems like a pretty solid guess.</p>
<p>Just FYI to the committee, if Phillips does show up for the hearing but suddenly vanishes, you might want to look for him in Dumfries, Virginia, the location of the nearest Waffle House. It&#8217;s only about 35 miles from the Capitol, so well within his range. </p>

<p>So you remember last year when I asked you to please do your best not to appear in the &#8220;AI Hallucination Database&#8221;? <em>See </em>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2025/06/please-do-your-best-not-to-appear-in-the-ai-hallucination-database.html">Please Do Your Best Not to Appear in the &#8216;AI Hallucination Database&#8217;</a>&#8221; (June 6, 2025). You do? Terrific. Because I don&#8217;t want you to end up like the now-former Assistant U.S. Attorney for the Eastern District of North Carolina, a man who now regrets his decision to use <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.wunc.org/2026-03-11/assistant-u-s-attorney-resigns-after-admitting-to-the-use-of-ai-to-draft-inaccurate-legal-brief">AI to draft a brief</a>.</p>
<p>In general, I think a good rule of thumb is: try to live your life in such a way that no judge feels compelled to create a slide deck to display your many errors. This man either did not follow that rule or failed in doing so.</p>
<p>As <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.law360.com/classaction/articles/2450187?nl_pk=849d529b-1524-4716-9226-566baf6686d3&amp;utm_source=newsletter&amp;utm_medium=email&amp;utm_campaign=classaction&amp;utm_content=2026-03-11&amp;read_main=1&amp;nlsidx=1&amp;nlaidx=3">Law360 reported this week</a> (sub. req&#8217;d), on March 2 a judge ordered the prosecutor to show up and explain why he should not be sanctioned for violating Federal Rule 11 given that he signed a response brief that included multiple fabricated quotations and misstated the holdings of several cases. The other side had pointed out the mistakes, and the prosecutor then filed a surreply attributing them to the &#8220;inadvertent filing of an unfinalized draft document.&#8221; Because that is also not something a lawyer should do, this isn&#8217;t a great defense. But the judge suspected there was more to it, and that the &#8220;more&#8221; was called &#8220;artificial intelligence.&#8221;</p>
<p>At the show-cause hearing on March 10, the prosecutor confirmed that this was indeed the case. </p>
<p>According to the report, he told the judge he had used AI to &#8220;&#8216;catch up&#8217; on a draft filing after realizing he&#8217;d accidentally overwritten it.&#8221; At first I thought &#8220;overwritten&#8221; meant it was too long or too flamboyant, like the brief was in the style of Edgar Allan Poe or something. But it probably means he claimed to have lost a lot of work because he saved the wrong version. Whatever it meant, the court wasn&#8217;t buying it at all. In fact, this happened:</p>

<p>Judge Numbers, clearly skeptical of [the prosecutor&#8217;s] statement, pulled up a slide deck which enumerated several errors in recent case filings and asked him to explain every single one. He said the mistakes appear &#8220;diametrically opposed&#8221; to [his] statement that the errors were unintentional.</p>
<p>&#8220;It&#8217;s difficult to credit your response given what you&#8217;ve done here,&#8221; Judge Numbers said, referencing a misattributed quote in circuit court case law.</p>

<p>I have been criticized by judges, but that criticism has usually been relatively minor, and definitely has never been laid out in a slide deck so the judge and I could go through my errors one by one. I&#8217;ve had relationships that ended that way, but so far my professional career has been free of it. I hope to keep it that way.</p>
<p>This is yet another example of a case where someone got caught using AI and not checking the results, <em>and </em>then did not admit what they had done. He didn&#8217;t mention AI in the surreply at all, and when the judge asked him about that omission at the hearing, he &#8220;replied that he and [his boss] decided the surreply was appropriate&#8221;&#8211;which isn&#8217;t really an answer. He insisted that all he had done wrong was to inadvertently file an unedited draft. The judge still wasn&#8217;t buying it.</p>

<p>Judge Numbers didn&#8217;t let up, expressing confusion at the concept of filing anything that wasn&#8217;t final. <em><strong>He asked why, for any reason, [the prosecutor] used generative AI to draft anything</strong></em>, knowing that attorneys around the country are facing sanctions for AI use.</p>

<p>Because he wanted to end up in the AI Hallucination Database? Sorry, I guess that was a rhetorical question.</p>
